You must be at least 18 years old and authorized to act for your organization if using on behalf of a business.

2. Services

NightLeakAudit provides operational outreach audits (e.g., after-hours call handling tests) and related reporting intended to help organizations understand and improve routing, responsiveness, and administrative contact capture.

3. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes
• Attempt to gain unauthorized access to systems/data
• Interfere with the Services or networks
• Upload malware or harmful code
• Misrepresent identity or affiliation

4. Calls and Outreach

We may place calls to publicly listed business phone numbers for operational audit purposes. We will honor reasonable requests to stop calling.

5. SMS Terms (Transactional Only)

If you provide a phone number and opt in, you may receive transactional messages including audit status updates, verification/security messages, and support confirmations.

• Opt-in: via web form consent.
• STOP/HELP: Reply STOP to stop; HELP for help.
• Rates: Message and data rates may apply.
• No marketing: no promotional texts from transactional lines.
• No PHI: no sensitive personal health information in SMS.

If you opt out, some features (status updates/verification) may not work.

6. Intellectual Property

We own the Services and related content, logos, and software. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works except as permitted by law.

7. Disclaimers

Services are provided "as is" and "as available." We disclaim warranties to the maximum extent permitted by law. We do not guarantee uninterrupted or error-free service.

8. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability will not exceed the amount you paid us in the 12 months before the event giving rise to the claim (or $100 if you paid nothing), whichever is greater.

9. Termination

We may suspend or terminate access if you violate these Terms or if required by law.

10. Changes

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
